Section 405 IAC 2-6-3 - Medicaid eligibility for former foster care children under age 26

Sec. 3.

(a) Beginning January 1, 2014, an individual who:
(1) is:
(A) less than twenty-six (26) years of age; and
(B) not eligible for and enrolled in other mandatory Medicaid coverage;
(2) on becoming eighteen (18) years of age, was in foster care under the responsibility of a state or federally recognized tribe's responsibility, whether or not under Title IV Part E of the Social Security Act; and
(3) was enrolled in a state plan under Title XIX of the Social Security Act, or under a waiver of a state plan while in foster care;

is eligible for Medicaid.

(b) The office shall not consider the income or resources of an individual described in subsection (a) when determining eligibility.
