Section 35 IAC 14-2-1 - Withholding of benefit payment

Authority: IC 5-10.5-4-2

Affected: IC 5-10.2-4

Sec. 1.

Benefit payments may be withheld under any of the following circumstances:

(1) Order of the board.

(2) To offset the overpayment of benefits to a member or beneficiary until the overpayment is repaid to the fund.

(3) Pending investigation after three (3) consecutive monthly benefit checks have been returned by the United States Postal Service as undeliverable.

(4) After notification of a member's death.

(5) Pursuant to court order.
