Sec. 45.
"Continuously flowing stream" means a body of water that has measurable velocity of flow for at least nine (9) months of the year or is designated as a perennial flowing stream on a United States Geological Survey (USGS) seven and one-half (7.5) minute series topographical map, but is not labelled as a river.
