Section 329 IAC 1-2-5 - Action on an application

Sec. 5.

(a) The commissioner shall approve a request for modification or termination of a restrictive covenant if the commissioner determines that the modification or termination meets the requirements of:

(1) IC 13-14-2-9; and

(2) this rule.

(b) The commissioner may authorize the filing of a supplemental recording to reflect an approved modification or termination of a restrictive covenant pursuant to IC 13-14-2-9(c). A supplemental recording must comply with section 6 of this rule.
