Sec. 3.
(a) If a discharger with a permit or an interested person believes that a modification, revocation and reissuance, or termination of a permit is justified under the standards of 327 IAC 5-2-16, he may request such action on the permit from the commissioner in writing. The request shall set forth all facts or reasons known to the requester which may be relevant to a decision thereon.(b) If the commissioner agrees, as a result of a request, that the modification, revocation and reissuance, or termination of a permit is warranted, the commissioner shall formulate a draft permit under 327 IAC 5-3-6.(c) If the commissioner decides that a request submitted under subsection (a) does not appear to meet the requirements of 327 IAC 5-2-16, the commissioner shall reply in writing to the discharger (and the person making the request, if different) briefly setting forth in writing the reasons for that decision.
