Section 327 IAC 2-6.1-8 - Emergency spill response actions

Sec. 8.

Notwithstanding any other section of this rule, emergency spill response actions take precedence over reporting requirements, and when emergency spill response activities render spill reporting inconsistent with effective response activities, communication of the spill report to the Indiana department of environmental management may be delayed. In situations where the spill report is delayed, the burden of proving the need for the delay shall be upon the responsible person.
