Sec. 1.
(a) The antidegradation standards established by section 3 of this rule apply to all surface waters of the state.(b) The antidegradation implementation procedures established in sections 4 through 7 of this rule apply to a proposed new or increased loading of a regulated pollutant to surface waters of the state from a deliberate activity subject to the Clean Water Act, including a change in process or operation that will result in a significant lowering of water quality.(c) The antidegradation implementation procedures for activities covered by an NPDES general permit authorized by the department apply according to the following: (1) The department shall complete an antidegradation review of the NPDES general permits.(2) After an antidegradation review of an NPDES general permit is conducted, activities covered by that NPDES general permit are not required to undergo an additional antidegradation review.Water Pollution Control Board; 327 IAC 2-1.3-1; filed May 29, 2012, 3:19 p.m.: 20120627-IR-327080764FRA
