Sec. 39.
"Sensitive area" means a site where conditions exist that pose a specific water quality threat to one (1) or more of the following:
(1) Aquifers used as a source of drinking water.(2) Public water supply wells.(3) Wellhead protection areas.(4) Drinking water supply reservoirs.(5) Areas requiring special protection, such as:(A) wetlands, except for wetlands constructed for manure management;(C) the critical habitat of an endangered species; or(D) natural areas, including:(ii) nature preserves, as regulated under IC 14-31;(iii) historic sites, as defined in section 21 of this rule; and(iv) public lands, as defined in IC 14-38-1-5.Water Pollution Control Board; 327 IAC 19-2-39; filed Feb 6, 2012, 2:58 p.m.: 20120307-IR-327090615FRA, eff Jul 1, 2012
