Sec. 6.
(a) Any owner or operator of an emission unit that is required to obtain a permit under section 1 of this rule shall submit a malfunction emission reduction program within one hundred eighty (180) days after a new emission unit commences operation.(b) The program must include:(1) the normal operating emission rate; and(2) the actions that will be taken to reduce emissions in the event of a malfunction to an emission rate that will not contribute to the cause of the violation of the ambient air quality standards established in 326 IAC 1-3.(c) The program must be based on the: (1) best estimates of type and number of startups, shutdowns, and malfunctions experienced during normal operation of the emission unit or emission control device; and(2) scope and duration of the conditions.(d) The program is subject to review and approval by the commissioner.Air Pollution Control Board; 326 IAC 1-6-6; filed Mar 10, 1988, 1:20 pm: 11 IR 2382Filed 12/30/2016, 9:45 a.m.: 20170125-IR-326150326FRA
