Section 312 IAC 29-7-4 - Notice requirements

Sec. 4.

(a) The notice required by section 3(2) of this rule shall include the following:

(1) A copy of the permit application.

(2) A statement that the proposed well may be exempted from the well spacing requirements of 312 IAC 29-13.

(3) Notice that operation of the well may result in drainage of gas from the adjacent properties.

(4) Notice that any person who objects to the well spacing exemption may file:

(A) written comments;

(B) objections; and

(C) a request for an informal hearing under 312 IAC 29-3-4;

within thirty (30) days of receipt of the notice.

(5) The address to which written objections, comments, or a request for informal hearing must be filed.

(b) The applicant shall provide proof of notice as required by section 3 of this rule to the division by submitting:

(1) a certified mail receipt; or

(2) a written statement from the recipient;

accompanied by a copy of the written notice.
