Sec. 27.
(a) If a notice of proposed individual civil penalty assessment becomes a final order in the absence of a petition for review or abatement agreement, the penalty shall be due upon issuance of the final order.(b) If an individual named in a notice of proposed individual civil penalty assessment files a petition for review in accordance with section 26 of this rule, the penalty shall be due upon issuance of a final administrative order affirming, increasing, or decreasing the proposed penalty.(c) Where the director and the corporate permittee or individual have agreed in writing on a plan for the abatement of or compliance with the unabated order, an individual named in a notice of proposed individual civil penalty assessment may postpone payment until receiving either a final order from the director stating that the penalty is due on the date of such final order, or written notice that abatement or compliance is satisfactory and the penalty has been withdrawn.Natural Resources Commission; 312 IAC 25-7-27; filed Jun 21, 2001, 2:53 p.m.: 24 IR 3603, eff Dec 1, 2001; readopted filed May 29, 2007, 9:51 a.m.: 20070613-IR-312070146RFA; readopted filed Sep 19, 2013, 10:12 a.m.: 20131016-IR-312130125RFAReadopted filed 3/26/2019, 3:40 p.m.: 20190424-IR-312190011RFA
