Section 312 IAC 25-7-11 - State enforcement; inability to comply

Sec. 11.

(a) No cessation order or notice of violation issued under section 5 or 6 of this rule may be vacated because of inability to comply.

(b) Inability to comply may not be considered in determining whether a pattern of violation exists.

(c) Unless caused by lack of diligence, inability to comply may be considered only in mitigation of the amount of civil penalty under sections 13 through 21 of this rule and of the duration of the suspension of a permit under section 7 of this rule.
