Section 312 IAC 25-6-88 - Underground mining; hydrologic balance; water rights and replacement

Sec. 88.

The permittee must promptly replace any drinking, domestic, or residential water supply that is contaminated, diminished, or interrupted by underground mining activities if the affected well or spring was in existence before the date the director received the permit application for the activities causing the loss, contamination, or interruption. The baseline hydrologic information required in 312 IAC 25-4-47 and 312 IAC 25-4-85 and the geologic information concerning baseline hydrologic conditions required in 312 IAC 25-4-30 and 312 IAC 25-4-71 will be used to determine the impact of mining activities upon water supply. Water replacement rights are not determined by this article.
