Section 312 IAC 25-1-126 - "Road" defined

Sec. 126.

(a) "Road" means a surface right-of-way for purposes of travel by land vehicles used in coal exploration or surface coal mining and reclamation operations. A road consists of the entire area within the right-of-way, including the following:
(1) Roadbed.
(2) Shoulders.
(3) Parking and side areas.
(4) Approaches.
(5) Structures.
(6) Ditches.
(7) Surface.
(8) Such contiguous appendages as are necessary for the total structure.
(b) The term includes access and haul roads constructed, used, reconstructed, improved, or maintained for use in coal exploration or surface coal mining and reclamation operations, including use by coal hauling vehicles leading to transfer, processing, or storage areas.
(c) The term does not include ramps and routes of travel within the immediate mining area or within spoil or coal mine waste disposal areas.
