Sec. 1.
The following definitions apply throughout this rule:
(1) "Eligible retiree" means an individual who:(A) has at least ten (10) years of creditable service with a state agency;(B) retires after June 30, 2000;(C) has accrued but unused and uncompensated sick, vacation, or personal leave on the employee's retirement date; and(D) has not previously received the benefits of converting leave under this rule.(2) "Retire" means terminate state employment at a time when the eligible retiree is entitled to begin receiving pension benefits from a public pension plan as a consequence of the retiree's state service.(3) "State agency" means an authority, board, branch, commission, committee, department, division, or other instrumentality of state government, but does not include the following: (A) A state educational institution (as defined in IC 20-12-0.5-1).(B) A state elected official's office.(C) The legislative and judicial branches of state government.State Personnel Department; 31 IAC 5-10-1; filed May 10, 2012, 2:32 p.m.: 20120606-IR-031110446FRAReadopted filed 6/1/2018, 9:50 a.m.: 20180627-IR-031180194RFA
