Sec. 14.
(a) Except as provided in any other law, if the board determines a practitioner has not complied with this rule or IC 25-1-8-6 at the time the practitioner applies for license renewal or reinstatement, or after an audit conducted under section 8 of this rule, the board shall do the following: (1) Send the practitioner a notice of noncompliance by certified mail to the practitioner's last known address.(2) Refuse to renew the license until the practitioner complies with subsection (b).(b) After receiving a notice of noncompliance under subsection (a), a practitioner shall do either of the following:(1) If the practitioner believes they have complied with this rule or IC 25-1-8-6, if applicable, within twenty-one (21) days after receiving the notice, send a written notice to the board requesting a review so they may submit proof of compliance or evidence of hardship under IC 25-1-4-4.(2) If the practitioner does not disagree with the board's determination of noncompliance, the following:(A) Except as provided in subsection (d), pay to the board a one hundred fifty dollar ($150) civil penalty within twenty-one (21) days after receiving the notice.(B) Within six (6) months after service of the notice, earn the number of credit hours needed to achieve full compliance.(c) If a practitioner fails to comply with subsection (b)(2) within the period provided, the board shall immediately refuse to reinstate the practitioner's license and send notice of the refusal to the practitioner by certified mail.(d) If the board determines a practitioner has knowingly or intentionally made a false or misleading statement to the board concerning compliance with the continuing education requirements, in addition to the requirements under this section, the board shall submit the practitioner for prosecution and impose a one thousand dollar ($1,000) civil penalty.(e) The board shall revalidate a practitioner's license if the practitioner provides proof of compliance with this rule under subsection (b)(1) or (b)(2).Indiana Board of Licensure for Professional Geologists; 305 IAC 1-6-14; filed 11/19/2024, 4:36 p.m.: 20241218-IR-305240166FRA
