Section 140 IAC 6-1-14 - Dealer's title; assignment and reassignment

Sec. 14.

(a) As used in this section, "dealer" means a dealer licensed under IC 9-32.

(b) A dealer may reassign a certificate of title without first applying for the title. If the dealer reassigns the vehicle to another dealer, that dealer may also reassign the title by using the applicable bureau designated form.

(c) The form described in subsection (b) must include:

(1) the vehicle's identification number, make, and year;

(2) the dealer's name, address, and dealer number;

(3) the date of sale or reassignment and selling price;

(4) the name and address of the purchaser;

(5) the name, address, and electronic lien and title identification number of the lienholder, if applicable;

(6) an odometer statement, if required by IC 9-17-2-6; and

(7) the affirmation statement contained in IC 9-17-2-3, signed by the dealer and purchaser.

(d) A dealer may reassign an out-of-state title on a bureau designated form unless the out-of-state title restricts reassignments.

(e) Whenever a nonelectronic title is used, a total of three (3) dealer reassignments may occur. After three (3) reassignments involving a nonelectronic title, the last named purchaser must apply for a certificate of title. Whenever an electronic title is used, an unlimited number of reassignments may occur.

(f) In making an assignment or reassignment, the dealer must place its dealer number on the certificate of title or applicable electronic form, or both.

(g) The person who signs the certificate of title or applicable electronic form, or both, on the dealer's behalf must place information about their position with the dealer on the title or applicable electronic form, or both, next to their signature.
