Section 1440.280 - Termination for Failure to Pay Taxes, Child Support or Student Loana) If the Division receives information that a licensee who has been issued a license under the Act has failed to pay or is more than 30 days in arrearage on taxes, court ordered child support or a student loan pursuant to Section 20-20 of the Act, the Division shall notify a licensee that his or her license will be automatically terminated in 30 days from the date of the notice, unless the appropriate administering agency provides to the Division information and proof that the licensee has corrected the failure to pay the arrearage.b) The licensee may request a hearing on the termination, but the hearing shall be limited to the presentation of evidence on the issues of mistaken identity, proof that the respondent has entered into a payment plan or that the debt has been discharged in bankruptcy.c) The Division and the Board shall not hear evidence as to whether a licensee has failed to pay or is in arrearage on the payments. The responsibility for the hearing of evidence is with the appropriate administering agency.Ill. Admin. Code tit. 68, § 1440.280
