Section 58.01.25.400 - COMPLIANCE EVALUATION01.Non-compliance Actions. When a permittee is or was not in compliance with conditions of the existing, terminated, or expired permit that has been administratively continued, the Department may choose to do one (1) or more of the following:a. Initiate an enforcement action;b. Issue a notice of intent to deny the new application. If the application is denied and the expired permit is no longer effective as provided in Subsection 101.02, the owner or operator must cease the activities authorized by the permit or be subject to enforcement action for operating without a permit;c.
