Section 34.07.01.011 - REQUIRED NOTIFICATION TO SECRETARY OF STATE01.Qualification Requirements. An individual qualifies to perform notarial acts for remotely located individuals by: a. Being duly commissioned as a notary public under Section 51-121, Idaho Code;b. Being authorized by the Secretary of State to perform electronic notarizations; andc. Providing notice by application to the Secretary of State that the notary public will be performing notarial acts facilitated by communication technology that meets the requirements of this chapter.02.Notification Form. The notification required under this section must be on a form as prescribed by the Secretary of State.03.Submission of Notification. The notification must be submitted to the Secretary of State in writing or as otherwise provided by information posted on the Secretary of State's website.04.Renewal of Commission. The renewal of the commission of a notary public who has previously qualified to perform notarial acts for remotely located individuals under this section constitutes renewal of the notary public's qualification without the necessity of submission of another notification under this section.05.Updated Technology. This section does not prohibit a notary public from receiving, installing, or using a hardware or software update to the technologies that the notary public identified under Subsection 011.02 of this chapter if the hardware or software update does not result in technologies that are materially different from the technologies that the notary public identified.Idaho Admin.
