Section 04.02.01.160 - DISCLOSURE REQUIREMENTS

It is an unfair and deceptive act or practice for a seller to solicit a sale or order for sale of goods or services at other than appropriate trade premises, in person or by means of telephone, without clearly, affirmatively, and expressly revealing at the time the seller initially contacts the consumer, and before making any other statement, except a greeting, or asking the consumer any other questions, that the purpose of the contact is to effect a sale, by doing all of the following: (3-31-22)

01.Solicitor's Identity. Stating the identity of the person making the solicitation. (3-31-22)
02.Trade Name of Seller. Stating the trade name of the seller represented by the person making the solicitation. (3-31-22)
03.Types of Goods or Services Offered. Stating the kind of goods or services being offered for sale. (3-31-22)
04.In-Person Contact. In the case of an "in person" contact, the seller making the solicitation shall, in addition to orally revealing the above information, show or display identification which states: (3-31-22)
a. The identity of the person making the solicitation; (3-31-22)
b. The trade name of the seller represented by the person making the solicitation; and (3-31-22)
c. The address of the place of business of one of such persons so identified. (3-31-22)
