Section 8-210.2-16 - Waiver

The requirements for public hearing and for notice may be waived by the governor when the state librarian, as a condition to receiving federal funds, is required by federal provisions to adopt rules and the state librarian is allowed no discretion in interpreting the federal provisions as to the rules required to be adopted. The state librarian shall make known to the public the proposed adoption, amendment, or repeal of any rule by publishing a statement as to the substance of the proposed rule change in a newspaper of general circulation in this State, at least once prior to the waiver of the governor.
