Section 7-2-25 - Setting aside

The commander may "set aside" non-judicial punishment when it is clear that an injustice has occurred, in which case all rights and privileges shall be returned to the member. This type of action would be necessary in a case where the receipt of previously unknown information convinces the commanding officer that the member is not guilty of an offense for which punishment has been imposed. If the non-judicial punishmentaction is set aside, all records of the proceeding shall be destroyed.
