Section 6-81-11 - Abandonment or discontinuance of service

Section 6-80-122 applies to any proposed abandonment or discontinuance of a service supported by the State or federal universal service support mechanisms, except that, as necessary, before allowing a telecommunications carrier to abandon or discontinue any service supported by the State or federal universal service support mechanisms, the commission shall require:

(1) The other telecommunications carriers receiving support from the State or federal universal service support mechanisms in the area served by the carrier seeking to abandon or discontinue service to ensure that all customers served by the carrier abandoning or discontinuing service will continue to be served; and

(2) Sufficient notice to permit the purchase or construction of adequate facilities by the other telecommunications carriers.

The purchase or construction required under paragraph (2) must be completed within one year of the date the commission approves the abandonment or discontinuance of service.
