Section 5-31-28 - Requiring a security bond or other guarantee from a non-custodial parent(a) A non-custodial parent owing arrearages exceeding the amount of child support due for a six month period may be required by child support order to give security, post bond, or give some other guarantee to secure payment of such arrearages.(b) The non-custodial parent shall not be required to provide such security when:(1) The non-custodial parent is receiving public assistance for the benefit of minor children;(2) The non-custodial parent does not have means to post bond or other security; or(3) It is not in the best interest of all the non-custodial parent's dependent children.(c) When commencing administrative process to require a non-custodial parent to give security, post bond, or give some other guarantee of payment, the agency shall proceed under section 5-31-22.
