Section 4-158-12 - Extension restrictionsThe board may impose the following restrictions on any lease extensions:
(1) No aggregate term period shall be less than fifteen years nor exceed sixty-five years;(2) The purpose of the extension shall be for a specific agricultural activity(ies) and may include waste or unusable lands for preservation of the surrounding environment and continuity of farming operations; and(3) The lease shall not be in violation of existing lease terms or conditions or be in arrears of rents due at the date of extension.[Eff DEC 06 2007] (Auth: HRS § 166E-5) (Imp: HRS § 166E-6)
