Section 3-149-201 - Contracts subject to appropriation of state funds(a) Every contract awarded pursuant to chapter 103F, HRS, shall, at all times, be subject to the appropriation of state funds, and may be terminated without liability to either the purchasing agency or the provider in the event that funds are not appropriated or available.(b) Clarification for multi-term contracts, A multi-term contract shall be subject to the availability and appropriation of funds for each and every fiscal year that it is in effect, and may be terminated without liability to either the purchasing agency or the provider in the event that funds are not appropriated or available for any fiscal year.[Eff 6/19/99; comp JAN 23 2006] (Auth: HRS § 103F-106) (Imp: HRS § 103F-414)
