Section 19-42-25 - Use permits; types

Use permits may be issued for the following respective uses:

(1) Mooring permit. A use permit authorizing the docking, mooring, or anchoring of a vessel at a state commercial harbor.
(A) Regular mooring permit. A use permit which on the date of issuance authorizes the permittee to moor a vessel in a harbor for a period of one year.
(B) Temporary mooring permit. A nonrenewable use permit which on the date of issuance authorizes the permittee to moor a vessel in a harbor for a period of thirty days or less as specified in the permit.
(2) Commercial permit. A use permit which authorizes the owner of a commercial vessel to use a state commercial harbor and its facilities for commercial activities as specified in the permit. A commercial permit is non-transferable, so that whenever a permittee parts with possession or transfers the title or interest in the vessel identified in the commercial permit to another person by any arrangement whatsoever, the commercial permit shall expire except as otherwise provided herein with respect to the original permittee. The new possessor, transferee, or owner of the vessel shall have no right to use the commercial permit. An original permittee holding a commercial permit upon written application to and approval by the department, may retain the commercial permit, provided that within thirty days the permittee resumes operation with another vessel owned by the permittee pursuant to the provisions of these rules.
(3) Miscellaneous permit. A use permit authorizing use of the harbor for such other purpose as may be permitted by the department consistent with these rules and applicable laws; provided that such other use shall be stated in the use permit. Use permits shall be issued only after a determination by the department that all applicable laws have been complied with and that all fees and charges payable at the time of the issuance or reissuance of a permit have been paid.
