Section 19-1-21 - Notice of proposed rulemaking
(a) When upon its own motion, the department proposes to adopt, amend or repeal a rule or regulation, a notice of the proposed rulemaking action will be published at least once in a newspaper of general circulation in the State at least thirty calendar days prior to the date of the public hearing. Notice shall be mailed to all persons who make a timely request for advance notice of such rulemaking hearing.
(b) A notice of the proposed adoption, amendment or repeal of a rule shall include:
(1) A statement of the date, time, and place where the public hearing shall be held.
(2) Reference to the authority under which the adoption, amendment, or repeal of a rule is proposed.
(3) A statement of the substance of the proposed rulemaking action.
