Section 17-2028-60.03 - Notification of Over-Income Status(a) The authority shall provide a family a notice in writing within 30 calendar days of the first discovery of their over-income status. The first written notice shall: (1) Notify the family of their over-income status;(2) State that by continuing to exceed the over-income limit for a total of 24 consecutive months, the family shall be subject to the over-income policy;(3) State that during the grace period, the family shall remain as public housing participants;(4) Provide an explanation of the authority's over-income policy set forth under section 17-2028-112; and(5) State that the family may request a grievance hearing to dispute the over-income finding.(b) The authority shall conduct an income reexamination one year following the initial over-income finding. If at such time the family remains over-income, the authority shall provide the family a second notice in writing within the following 30 calendar days. The second written notice shall:(1) Notify the family that its annual income has exceeded the over-income limit for 12 consecutive months;(2) State that continuing to exceed the over-income limit for the next 12 consecutive months will result in the family being subject to the over-income policy;(3) Provide an explanation of the authority's over-income policy set forth under section 17-2028-112; and(4) State that the family may request a grievance hearing to dispute the over-income finding.(c) The authority shall conduct an income reexamination of an over-income family at the expiration of the 24-month grace period. If at that time the family remains over-income, the authority shall provide a third notice in writing within the next 30 calendar days. The third written notice shall:(1) Notify the family that its grace period has expired;(2) Explain that the family's tenancy shall be terminated within the following six month pursuant to the authority's over-income policy set forth in section 17-2028-112;(3) Provide an explanation of the authority's over-income policy set forth under section 17-2028-112; and(4) State that the family may request a grievance hearing to dispute the over-income finding.Haw.
