Section 17-895.1-4 - Fines(a) The operation of a child care facility without a license is a violation and shall be punishable by a fine not to exceed the maximum amount allowable under the law.(b) The following offenses may be punishable by a fine, not to exceed the maximum amount allowable under the law, and may also be subject to the denial, suspension or revocation of a license: (1) Caring for more children than allowed by the facility's license;(2) Violation of the staff-child ratios;(3) Improperly certifying staff credentials;(4) Failure to comply with timely request for background check as required in chapter 801;(5) Allowing conditions to exist at the facility which constitute a risk of harm or an imminent danger to the health, welfare, or safety of the children; or injuries to children resulting from the conditions;(6) Failure to report suspected child abuse or neglect that has occurred or will occur; or(7) Any behavior that may create an unsafe or unhealthy environment or may pose a risk of harm to children.Haw.
