Section 17-798.3-24 - Waitlist(a) The department may implement a waitlist for child care subsidy payments whenever it determines that sufficient funding is not available to sustain payments for all of the applicants requesting assistance.(b) The following are not subject to the waitlist:(1) A family unit who needs child care payments to comply with the First-To-Work (FTW) program participation requirements;(2) A family unit whose child is receiving child protective services, and the need for child care is specified in the family unit's case plan as ordered by the court; and(3) Former TANF participants who are eligible for Transitional Child Care pursuant to section 17-798.3-36.(c) When the waitlist is in effect, the department shall prioritize applicants using the following:(1) Family units with gross incomes at or below 100% of the Federal Poverty Guideline (FPG) for a family of the same size shall be income-ranked by dividing their monthly gross income by the income limit for a family of the same size;(2) Family units with gross incomes above 100% of the FPG for a family of the same size shall be income-ranked by dividing their monthly gross income by the income limit for a family of the same size; and(3) Date an application is received by the department.(d) Upon determining funds are available, the department shall select waitlisted family units by priority, as established in subsection (c), and provide notification of eligibility for program enrollment as established in section 17-798.3-8.(e) Waitlisted family units selected for child care payments shall meet all eligibility requirements as established in section 17-798.3-9 at the time of notification of eligibility for program enrollment; provided that if the waitlisted family unit is not eligible, the caretaker will be notified of the application denial.(f) Eligibility for the initial payment shall be the later of:(1) The month that requirements of section 17-798.3-9 are verified by the department; or(2) The eligible child's first day in child care.(g) Assignment of applicants to the waitlist shall be final and conclusive and not subject to an administrative appeal under section 17-798.3-21.
