Section 17-684.1-65 - Fifteen per cent ABAWD exemption(a) The department may exempt specified ABAWD recipients from ABAWD time-limits, pursuant to section 1001 of the Balanced Budget Act of 1997 , Pub. L. No. 105-33, 111 Stat. 215. The average monthly number of exemptions granted pursuant to this section shall not exceed fifteen per cent of the number of covered individuals during the federal fiscal year.(b) The ABAWD population that may be eligible for the exemption may include but is not limited to: (1) Individuals who have completed a prescribed amount of job search;(2) Individuals who are working less than twenty hours per week;(3) Individuals enrolled in General Educational Development (GED) or English as a Second Language (ESL) classes for less than twenty hours per week;(4) Non-English speakers; or(5) Any other group the department determines eligible for the exemption.(c) ABAWD recipients who are eligible for the exemption shall remain subject to the work requirements of this chapter.Haw.
