Section 17-684.1-16 - Self-employed person exemption
(a) A person who is self-employed, and who works a minimum of thirty hours per week, or who receives weekly gross earnings equal to the federal minimum wage multiplied by thirty hours, shall be exempt from the work registration requirement.
(b) Verification of self-employment shall be as follows:
(1) If a person claims to be exempt by reason of self-employment, verification of the amount of income received from self-employment shall be sufficient to establish the exemption, provided the amount of income appears to be consistent with a conclusion of full-time (thirty hours per week) employment; and
(2) If the reported income is not sufficient to establish an exemption, and the number of hours worked a week is questionable, the person shall cooperate with the department in establishing that the volume of work claimed justifies a determination that the self-employment enterprise is a full-time job for the purposes of this exemption. The household shall cooperate in providing adequate documentation to substantiate the claim.
