Section 17-680-10.1 - Prospective eligibility for all financial assistance households(a) Eligibility is determined prospectively based on the department's best estimate of the household's composition, countable income and assets, and other eligibility factors that are expected to exist in a current month and future month.(b) Ineligibility shall be determined as follows: (1) For simplified reporting households the household shall be ineligible: (A) In the month the household's income is anticipated to exceed the gross income limit or the net income limit or there is a change in household composition which results in ineligibility; or(B) The month following the month other eligibility factors become known to the department and results in ineligibility.(2) For change reporting households the household shall be ineligible for financial assistance in the month the household's income exceeds the gross income limit or net income limit, the household's assets exceed the retention limit, or the household does not meet other eligibility factors.(c) Action shall not be taken if the household will not continue to be ineligible in future months.(d) In the month of application, a household's eligibility shall be determined for the month of application by considering the household's circumstances for the entire month of application.Haw.
