Section 17-402-4 - Eligibility for services(a) The division and branch shall assume responsibility to determine eligibility of a blind and visually handicapped person for vocational rehabilitation and related services.(b) Determination of eligibility shall be based upon findings resulting from a preliminary diagnostic study which shall be sufficient to determine whether the individual has: (1) A severe visual loss which results in legal blindness:(A) Central visual acuity does not exceed 20/200 in the better eye with correcting lenses.(B) Visual acuity is greater than 20/200 but is accompanied by a limitation in the field of vision such that the widest diameter of the visual field subtends an angle no greater than 20 degrees.(2) A severe visual impairment which interferes with performance of ordinary activity for which sight is essential.(3) The capability to benefit from services of the branch and that services will enable the individual to be rehabilitated into gainful occupations, to increase capacity for independence, and to reduce the functional limitations of visual loss.(c) Eligibility shall be determined without regard to sex, race, color, creed, or national origin.(d) Eligibility for vocational rehabilitation services shall also be determined in accordance with § 17-401-5.[Eff.
