Section 17-1737-105 - Waiver of other Medicaid benefits(a) An individual who elects hospice services shall waive all rights to Medicaid payments for services related to the treatment of the terminal condition for which hospice care was elected. This provision shall not apply to individuals under twenty-one years of age.(b) Medicaid payments may be made for hospice and related services provided by: (1) The designated hospice;(2) Another hospice under arrangements made by the designated hospice; and(3) The individual's attending physician if that physician is not an employee of the designated hospice or receiving compensation from the hospice for services to the individual.(c) Medicaid payments may be made for other Medicaid covered services unrelated to the terminal condition for which hospice care was elected.Haw.
