Section 17-1737-15.1 - Examination for, determination, and certification of mental disability(a) The department shall designate providers to conduct the mental examinations.(1) Selection of the providers shall be based on the following: (A) Past history of conducting and reporting on mental examinations that meet the department's standards.(B) An understanding of the purpose, pertinent issues and potential problems of the new examination and the services that the department expects it to provide.(C) Responsiveness and responsibility to assist the department in achieving its goals. (b) For a determination and certification of mental disability, the department shall designate a board to determine and certify mental disability. The following shall apply to the board to determine and certify mental disability: (1) The board shall consist of licensed physicians who are actively engaged in the practice of psychiatry in the State and a licensed psychologist actively engaged in the practice of psychology in the State; and(2) The duties of the board shall be to determine and certify mental disability of applicants and recipients for general assistance.Haw.
