Section 17-1424-10 - Appeals and hearings(a) Any center whose certificate of approval is to be suspended or revoked shall be given written notice addressed to the center's last known mailing address.(b) The notice shall contain a statement of the reasons for the proposed action and shall inform the licensee of the right to appeal the decision to the director of the department in writing, within ten working days after the mailing of the notice of the proposed action.(c) The director of the department shall give a written acknowledgement of the receipt of the appeal to the licensee. The acknowledgement shall be given no later then fifteen calendar days following the receipt of the timely written appeal. The department shall provide an opportunity for a prompt hearing before a departmental hearing officer with respect to the proposed action. On the basis of the evidence adduced at the hearing, the hearing officer shall make the final decision of the department as to whether the certificate of approval shall be suspended or revoked.(d) If no timely written appeal is made, the certificate of approval shall be suspended or revoked as of the termination of the ten day period.Haw.
