Section 16-79-79 - Reporting of adverse occurrences
(a) All licensed dentists in the practice of dentistry in this State shall submit a report within a period of thirty days to the board of any mortality or other incident which results in temporary or permanent physical or mental injury requiring hospitalization of a patient during or as a direct result of anesthesia related thereto. The report shall include at the minimum responses to the following:
(1) Description of the dental procedure;
(2) Description of the physical condition of the patient unless the patient has a Class I status as defined by the American Society of Anesthesiologists;
(3) List of drugs and dosage administered;
(4) Detailed description of techniques utilized in administering the drugs utilized;
(5) Description of the adverse occurrence:
(A) Symptoms of any complications, including but not limited to onset and type of symptoms of the patient;
(B) Treatment instituted on the patient;
(C) Response of the patient to the treatment; and
(6) Description of the patient's condition on termination of any procedure undertaken.
(b) Failure to comply with subsection (a) when the occurrence is related to the use of general anesthesia, deep sedation, or moderate (conscious) sedation shall result in the loss of the written authorization or permit of the licensed dentist to administer or to employ another person to administer general anesthesia, deep sedation, or moderate (conscious) sedation.
