Unless waived by the commissioner, every investment adviser that is registered or required to be registered under chapter 485A, HRS, and this chapter shall furnish each advisory client and prospective advisory client with a written disclosure statement that complies with the provisions of the Investment Advisers Act, 17 CFR section 275.204-3, notwithstanding the fact that the investment adviser is not registered or required to be registered under the Investment Advisers Act. The delivery and updating of the disclosure statement required by this section shall be done in accordance with the requirements of Investment Advisers Act, 17 CFR section 275.204-3.
