Section 16-201-1 - Purpose, scope, and construction

This chapter is intended to provide uniform rules of administrative procedure to govern all proceedings brought before any authority of the department of commerce and consumer affairs, State of Hawaii, the purpose of which is to obtain:

(1) A determination of any contested or controverted matter within the authority's jurisdiction, through an evidentiary hearing;
(2) A declaration as to the applicability, with respect to a factual situation, of any rule or order of the authority or of any statute which the authority is required to administer or enforce; or
(3) The adoption, modification, or repeal of any rule of the authority which is initiated by petition.

This chapter shall be construed to secure the just, equitable, speedy, and inexpensive resolution of matters brought before the authority. Whenever this chapter is silent on a matter, the authority or hearings officer may refer to the Hawaii Rules of Civil Procedure for guidance.
