Section 16-131-68 - Penalties(a) If the director determines, after a hearing in accordance with chapter 91, HRS, that any cable operator has violated section 440G-9(b)(1) through (8) as amended, HRS, the director may fine the cable operator an amount not less than $50 nor more than $25,000 for each separate violation.(b) If the director has provided a cable operator with written notice of a potential violation, each day's continuance of an apparent violation may be deemed a separate violation. Nothing in this subsection shall limit the aggregate amount of the fine imposed on any cable operator as a result of any violation that continues subsequent to notice of a potential violation.(c) A violation that concurrently affects more than one subscriber of a cable system shall be deemed an event which constitutes a single violation.
