No owner of a dam or reservoir shall impound water without a valid certificate of approval to impound water at the dam or reservoir. A certificate of approval to impound shall be valid for five years from the date of issuance, unless otherwise stated by the department, and provided all conditions of the certificate are fulfilled and maintained to the satisfaction of the department.
