Section 13-167-42 - Notice of hearing(a) Notice of proposed rulemaking shall be published at least once in a newspaper of general circulation in the state and in each county affected by the proposed rule. All notices shall be issued at least twenty days prior to the date set for public hearing.(b) A notice of the proposed issuance, amendment, or repeal of a rule shall include: (1) A statement of the date, time, and place where the public hearing shall be held;(2) Reference to the authority under which the issuance, amendment, or repeal of a rule is proposed;(3) A statement of the substance of the proposed rulemaking; and(4) In the case of a proposal to establish, change, or review hydrologic unit boundaries, in addition to the foregoing, a statement of the time and place where maps showing the proposed or existing boundaries within the county may be inspected prior to the public hearing.(c) In any rulemaking proceeding where the commission deems it necessary, a further notice of proposed rulemaking may be published in a newspaper of general circulation in the state.[Eff.
