Section 13-1-32.2 - Enforcement by department

In contested cases involving alleged violations of law, to the extent necessary, the department shall be treated as a party for the purpose of establishing the agency's case and staff members may be called as witnesses. The department's activities in relation to the enforcement action shall be performed or supervised by a first deputy to the chairperson.
