Section 12-42-88 - Decision and order(a) In the matter of a petition relating to employee participation in a strike, the board may dismiss the petition or find that the employee strike is unlawful and issue an order directing the employee or employees to cease and desist from participating in the strike.(b) In the matter of a petition relating to a strike about to occur or in progress which presents an imminent or present danger to the public health or safety, the board may dismiss the petition or, if it finds that there is imminent or present danger to the health or safety of the public, the board shall establish specific requirements that must be complied with and which shall include, but not be limited to: (1) Designation of essential positions; and(2) Any other requirement it deems necessary in order to avoid or remove any imminent or present danger to the health or safety of the public. The board shall retain jurisdiction to amend the order made, upon good cause shown, at any time during the strike.
(c) In the matter of a petition relating to a strike declared or authorized by an employee organization, the board may dismiss the petition or find that such strike is or would be in violation of chapter 89, HRS, and issue an order directing the employee organization to withdraw such strike declaration or authorization and desist from striking.[Eff.
