Section 12-41-63 - Procedure in conducting preliminary investigation

The preliminary investigation shall be conducted by the board or by its hearings officer in such manner and at such places as shall be deemed suitable and appropriate under the circumstances with due regard for the purpose and intent of section 380-14(b) and (c), HRS, All proceedings conducted in the course of the preliminary investigation may be ex parte and the board or hearings officer may proceed without the presence of all parties concerned. The board or the hearings officer shall give notice immediately to all parties concerned regarding the preliminary investigation, and shall afford reasonable opportunity to all parties concerned to present all relevant and material facts pertinent to the inquiry.
