Section 12-41-48 - Protested ballots

If a dispute arises in any election referendum concerning the eligibility of a particular employee to vote therein, the ballot of the employee may be received under protest by the agent of the board conducting the election. All protested ballots shall be placed in individually marked envelopes. If the protested ballots are necessary to a final determination, the board or its hearings officer may hold a hearing upon due notice, and shall decide the eligibility of the employee.
