If the conciliator fails to bring the parties to agreement within the period required by section 12-41-89, the board shall immediately notify the parties that the labor dispute shall be referred to a three-member arbitration panel established in accordance with section 89-11(e) (2) (A), HRS, and rules as prescribed by the board.
